DAO Analysis

The DAO ecosystem is moving fast across three simultaneous dimensions: technical governance infrastructure is maturing; legal recognition frameworks are proliferating globally; and regulatory agencies from FINMA to the SEC are developing positions on DAOs that will shape the next decade of decentralised organisation.

This section publishes original analysis and editorial on the forces shaping DAO governance. That includes: forward-looking assessment of how DAO legal frameworks are evolving across jurisdictions, analysis of significant governance events and what they reveal about DAO design, regulatory developments and their implications for operating DAOs, and the longer-arc questions about whether DAOs represent a durable organisational form or a transitional experiment.

Switzerland’s position in this analysis is structural rather than merely geographic. FINMA’s principles-based approach, the Swiss Civil Code’s flexible association and foundation law, and Crypto Valley’s concentration of DeFi protocol foundations make Switzerland a natural laboratory for DAO legal and regulatory development. When the next jurisdiction enacts DAO-specific legislation, Swiss practice will have informed the design.
